1. Scope

These Terms and Conditions govern all purchases from Red Hot Foods (Finnass Trading UG (haftungsbeschränkt)) made by consumers via our online store at www.redhotfoods.de. By placing an order, you agree to these Terms and Conditions in the version valid at the time of your order.

3. Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the “Buy Now” button, you submit a binding offer to purchase the items in your cart.

We accept your order by sending an order confirmation via email or by dispatching the goods.

4. Prices and Payment

All prices are stated in euros (€) and include VAT where applicable. Shipping costs are shown separately during checkout.

Available payment methods are displayed at checkout. We reserve the right to restrict certain payment methods for security or operational reasons.

5. Delivery

Standard delivery within Germany is usually 2–4 working days after payment is received.

International delivery times may vary and may be longer.

We are not responsible for delays caused by circumstances beyond our control, including courier delays, strikes, extreme weather, or customs processing.

If a product is unavailable after your order has been placed, we will inform you immediately and refund any payment received.

6. Right of Withdrawal

Consumers have a legal right to withdraw from their order within 14 days without giving any reason.

7. Withdrawal and Returns

If you exercise your statutory right of withdrawal, you are responsible for the direct cost of returning the goods, unless the item is faulty, damaged, or incorrect.

Returned goods must be handled in accordance with statutory requirements. For hygiene reasons, sealed food products may be excluded from withdrawal once unsealed.

8. Warranty

Your purchase is covered by statutory warranty rights under German law.

If goods are defective, you are entitled to request repair, replacement, or refund in accordance with applicable legal provisions.

9. Liability

We are liable without limitation for intent and gross negligence, as well as for injury to life, body, or health.

For slight negligence, we are only liable for breaches of essential contractual obligations (cardinal duties), limited to foreseeable damages typical for the contract.

As a limited liability company (UG), liability is limited to the company’s assets. Personal liability of shareholders is excluded.

10. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Germany.

Mandatory consumer protection provisions of the EU member state in which the consumer has habitual residence remain unaffected.

11. Final Provisions

If any provision of these Terms is found to be invalid, the validity of the remaining provisions shall not be affected.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
